High court won't rehear Ashcroft lawsuit concerning 9/11

BOISE, ID (KFVS) - John Ashcroft is told by a federal appellate court that he can be held responsible for a case that came up after 9/11.

The 9th Circuit Court of Appeals said Thursday, that it won't change its ruling that the former attorney general "can be held personally responsible for the misuse of the material witness statue."

The ruling was not unanimous, the eight judges fought over their interpretation of the law.

U.S. citizen Abdullah al-Kidd sued Ashcroft and other federal officials after he was arrested and jailed as a material witness in a terrorism case against another man.

He says it was just a trick to give the government time to see if he was involved in any other crimes.

He was never called to testify in the trial.
